OFFICIAL RULES
NO PURCHASE NECESSARY – PARTICIPANTS NEED NOT BE PRESENT TO WIN - Entries will be accepted starting on December 15, 2007.
1. ELIGIBILITY: This sweepstakes is open to all natural persons who are 18 years of age or older and are legal residents of the state of Florida, except employees and the immediate families of employees of Winterfest, Inc., its affiliates, subsidiaries, and promotion agencies. Void where prohibited or restricted by law. All federal, state and local laws and regulations apply. Winner will be responsible for all federal, state and local taxes where applicable. Participants need not be present to win. Winterfest is entitled to interpret these rules as needed and its decisions are final.
2. By entering this sweepstakes participant certifies the following: participant is 18 years of age or older, has complied with all of the official rules of this contest, agrees to be bound by the Official Rules, and is willing to receive electronic discounts and other promotions from Winterfest, Inc. and their sponsors.
3. TO ENTER: One Entry Per Person. MULTIPLE ENTRIES BY THE SAME PERSON WILL BE DISCARDED. To enter, complete this official entry form and vote for your favorite decorated entry via this website before January 5, 2008 OR send a 4” x 6” postcard postmarked by JANUARY 1, 2008 clearly listing your name, address, daytime phone number and the BOAT NUMBER for which you are voting to: WINTERFEST, INC. 512 NORTHEAST 3RD AVENUE, FORT LAUDERDALE, FLORIDA 33301 OR text message your vote with your wireless phone to 56121 – just enter your favorite parade entry before JANUARY 5, 2008. Illegible entries will be discarded. Mailed entries bearing a post-mark after January 2, 2008, are ineligible to win. Text message entries received after January 5, 2008, are ineligible to win. Winterfest, Inc. and its sponsors are not responsible for any typographical errors transferring the data from the mailed postcard to an electronic entry form, for any entries lost prior to being received by Winterfest, Inc., whether by electronic failure, postal error, Acts of God or otherwise, nor for any technical, electronic, telephone, hardware, software or network, computer or data transmission errors, malfunctions or difficulties of any kind. Lost, stolen, late, incomplete, illegible, damaged, postage-due or misdirected entries are ineligible. By submitting an entry form, whether electronically, via mail or by text messaging, participant represents and warrants to Winterfest, Inc. and its sponsors that he/she has read, understands and has complied with all of the Official Rules of this sweepstakes. All entries become the property of the Winterfest, Inc. and none will be returned.
4. Subject to any governmental approval which may be required, Sponsors reserve the right, without prior notice and at any time, to terminate or suspend the sweepstakes, in whole or in part, or modify the sweepstakes in any way, should any factor (including but not limited to fraud or security breach) interfere with the proper conduct of this sweepstakes as contemplated by these Official Rules, or if Sponsors believe that the sweepstakes has been or will be compromised in any way. Anyone found attempting to defraud Sponsors in any way will be disqualified.
5. PRIZES: Prize will be two airline tickets aboard Southwest Airlines. (Black out dates and restrictions may apply). One prize will be awarded. Total prize value ranges between: $200.00 to $800.00. Winner may not substitute, transfer or redeem his/her prize for cash. Sponsor reserves the right to substitute a prize of equal or greater cash value. Sponsor is not responsible for winner limitations that prevent acceptance or use of any prize.
6. ODDS OF WINNING: Odd of winning depends on the number of eligible entries received.
7. DRAWING: Winners will be selected in a random drawing from among all eligible entries received. The drawing will be held on January 10, 2008. Winterfest, Inc. will select the winner in accordance with these Official Rules, and Winterfest, Inc.’s decision shall be final.
8. WINNER NOTIFICATION / RELEASES: Winner will be notified by telephone or by electronic mail, and must claim the prize within ten (10) days after prize notification. Non-compliance with this rule or within this time period will result in prize being forfeited and an alternate winner being selected. Any prize notification that is undeliverable, and any prize that has not been accepted by the winner or is returned to the sponsor or its agencies as undeliverable will result in disqualification and the award of the prize to an alternate winner. Winner may be responsible for other costs, expenses and or taxes not specified as part of the prize package. Winners will be required to complete, sign and return an affidavit of eligibility and liability and publicity release within ten (10) days of prize notification. Noncompliance with this rule or within this time period will result in the prize being forfeited and an alternate winner will be selected. By participating, the winner agrees to release, indemnify, hold harmless and agrees to defend Winterfest, Inc., its sponsors, officers, directors, agents and employees from any and all losses, damages, rights, liability, claims or actions of any kind whatsoever for injuries, death, damages, or losses to persons or property which may be sustained in connection with participation in the sweepstakes and/or the receipt, ownership or use/misuse of any prize, or while preparing for, participation in, and/or traveling to any prize-related activity. Acceptance of the prize constitutes the participant’s permission to use winner's name, voice, biographical information and/or likeness for advertising or promotional purposes without further consent, approval or compensation for such use. The winner will be required to comply with and pay any and all taxes or other governmental obligations imposed on the winner and/or the prize.
9. WINNERS LIST: A Winner List can be obtained by sending a separate self-addressed, stamped envelope to: Winterfest, Inc. 512 Northeast 3rd Avenue, Fort Lauderdale, Florida 33301. Request for the winners list must be postmarked by January 15, 2008.
10. This sweepstakes is being conducted only in the state of Florida, and is not valid in any other states or territories of the United States.
